Terms and guarantee

What you are buying
Nearside is a monthly service at £149 a month, with a one off setup fee of £249 charged alongside your first month.
It covers your Google Business Profile, two counter stands and five staff tap cards, a reply to every review within 48 hours, and a one page report at the start of each month.
A website is not included. If you want one built it is a separate one off job, quoted before any work starts, and you own it.
The minimum term is three months. After that it runs month to month, and either of us can end it with thirty days written notice.

The guarantee
If you do not receive at least twelve new Google reviews in your first ninety days, you pay nothing for your fourth month.
The ninety days start on the day your counter stands are delivered, not the day you sign.
The guarantee applies on one condition: the stand stays out on your counter during your normal opening hours. If it is in a drawer, the guarantee does not apply. There is no requirement that your staff ask every customer, because neither of us can police that fairly.
Your monthly report shows the pace from the second week onwards, so if it is heading for a miss you will know well before month four rather than find out at the end.
A review counts towards the twelve whether it is good or bad. I cannot control what people write and neither can you.
Twelve is the number I will sign for. Most businesses pass twenty. I would rather promise a figure I can hold to in a quiet January than one that looks better on a website.

What I will not do
I will not offer anyone a discount, a free coffee or anything else in exchange for a review. I will not filter customers so that only the happy ones get asked. I will not write reviews, and I will not buy them.
All three of those breach Google’s policies. They also get review histories wiped, which would undo the thing you are paying me for.
If you ask me to do any of them, I will say no and explain why. If you do them yourself, the guarantee stops applying.

Who owns what
Your Google profile is yours. It always was. I work on it with the access you give me, and you can take that access away at any time.
If you pay me to build a website, you own it outright once it is paid for. If you leave, I will point the domain wherever you tell me and hand over the files within fourteen days. I do not hold a site hostage to keep a client.
The photographs I take of your premises are yours to use however you like.
The counter stands and cards are yours once the setup fee is paid.

Replies to reviews
I reply to every review within 48 hours of it appearing, in your name, in your voice.
For anything difficult, a complaint about a bill or a job that went wrong, I will draft the reply and send it to you before it goes public. You have the final word on what is said about your own business.

Paying
Monthly by direct debit, on the same date each month. The first payment covers the £249 setup fee and month one together.
If a payment fails I will contact you before I do anything else. If it is still unpaid thirty days later I will pause the work, and posting and review replies stop until it is sorted.

Ending it
After your minimum term, thirty days written notice by email is enough. No phone call to talk you out of it, no retention offer.
I will keep working normally through the notice period, including the final monthly report.
If I end it, you get the same thirty days, and I will refund any part month you have paid for.
Who you are dealing with
Nearside
Nearside is a trading name of a sole trader based in Billericay, Essex. There is one person behind it and you will be dealing with him.
These terms are governed by the law of England and Wales.
